When a TLC driver gets a moving violation, the TLC penalty comes on top of whatever the DMV does. One stop, two separate cases.
These are the hazardous violations, and every one of them carries TLC points.
The points
| Violation | Points |
|---|---|
| Speeding 1 to 10 mph over | 3 |
| Speeding 11 to 20 mph over | 4 |
| Speeding 21 to 30 mph over | 5 |
| Speeding 31 to 40 mph over | 6 |
| Speeding 41+ mph over | 8 |
| Not stopping for a school bus | 5 |
| Following too closely | 4 |
| Red light | 3 |
| Stop sign or yield sign | 3 |
| Not yielding right of way | 3 |
| Unsafe passing or lane change | 3 |
| Driving on the wrong side | 3 |
| Leaving the scene, property damage | 3 |
The fine is up to $400 each, on top of the points.
The 15-month window
| Points in 15 months | What happens |
|---|---|
| 6 to 9 | Suspended up to 30 days |
| 10 or more | You lose the licence |
One 21-mph-over ticket is 5 points. A single red light on top of that gets you suspended.
If you are anywhere near 6 points, a hearing is not a tactic. It is survival.
A Point Reduction Course can also take points off before a Persistent Violator summons is decided.
Two tickets, two places, and we handle one
The DMV ticket and the TLC summons come from the same stop but they are separate cases, decided in different places under different rules.
| Where it goes | Who can speak for you | |
|---|---|---|
| The DMV ticket, points on your driver licence | DMV Traffic Violations Bureau | An attorney, always. Anyone else only if the judge allows it |
| The TLC summons, points on your TLC licence | OATH Hearings Division | You, or a registered representative. This is the part we do |
At the TVB, anyone who is not an attorney can only appear if the judge permits it. It is not a right you can count on. So we do not take TVB cases. If you want someone standing up on the DMV ticket, that is a traffic attorney. You can also fight it yourself by mail.
What we handle is the OATH side. For a working driver that is usually the side that decides whether you keep driving, because suspension and revocation run on TLC points. And a DMV conviction is what triggers the TLC summons in the first place.
